1What My Union Paycheck is

My Union Paycheck is an independent service that reviews the earnings statements you submit against the terms of your applicable union contract and other pay rules, and flags possible discrepancies for your own review.

2Eligibility

You must be at least 18 years old and able to form a binding contract to use the service. You may submit only earnings statements and information that belong to you and that you are authorized to share.

3Your account

You're responsible for the information you give us and for keeping your account credentials secure. Please give us accurate information and keep it up to date, and let us know promptly if you believe your account has been accessed without your permission.

4What you submit

You keep ownership of the earnings statements, documents, and information you submit ("your content"). You give us a limited license to store and process your content solely to provide the service to you — for example, to run the review, generate your reports, and keep your statements available to you. You confirm that you have the right to submit your content and that doing so doesn't violate anyone else's rights or any agreement you're bound by.

5Subscriptions & billing

My Union Paycheck is offered as a paid annual subscription. When paid plans are available, you authorize us and our payment processor to charge the plan fee, plus any applicable taxes, at the price shown at checkout.

Unless stated otherwise at checkout, subscriptions renew automatically each year at the then-current price so your coverage doesn't lapse. We'll tell you the price and the renewal date before you buy, and we'll give you notice before any renewal price change. You can turn off automatic renewal at any time from your account or by contacting us.

6Cancellation & refunds

You can cancel at any time. Cancelling stops the next renewal; your access continues through the end of the period you've already paid for. Fees are non-refundable except where required by law.

7Acceptable use

When you use My Union Paycheck, you agree not to:

• submit documents or information that aren't yours or that you're not authorized to share;
• use the service for any unlawful purpose or in violation of any agreement you're bound by;
• attempt to access, disrupt, or reverse-engineer the service or its security; or
• resell, scrape, or use the service to build a competing product.

8Accuracy & no guarantee

Our review depends on the information you provide and on our understanding of the applicable contract terms and pay rules, which are complex and change over time. We work to be accurate, but we don't guarantee that our reports are complete or error-free, that we'll identify every discrepancy, or that anything we flag is in fact owed to you. We don't guarantee that you'll recover any amount. You're responsible for verifying our findings and for any decision or action you take based on them.

9Intellectual property

The service, including its software, design, and content we create, belongs to us or our licensors. We give you a personal, non-transferable right to use the service and the reports we generate for you for your own purposes. The reports we prepare for you are yours to use, including sharing them with your union steward or representative.

10Disclaimer of warranties

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

11Limitation of liability

To the fullest extent permitted by law, My Union Paycheck will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost wages, lost profits, or lost data, arising out of or relating to your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

12Indemnification

You agree to indemnify and hold harmless My Union Paycheck and its people from claims and costs arising out of your content, your use of the service, or your violation of these terms, except to the extent caused by us.

13Termination

You can stop using the service and close your account at any time. We may suspend or end your access if you violate these terms or if we need to for legal or security reasons. Sections that by their nature should survive termination — such as accuracy disclaimers, limitation of liability, and indemnification — will survive.

14Changes

We may update the service and these terms from time to time. If we make a material change, we'll update the effective date above and, where appropriate, notify you. Continuing to use the service after a change means you accept the updated terms.

15Governing law & disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before filing any formal claim, you agree to first contact us and try to resolve the issue informally for at least 30 days. Any dispute that can't be resolved that way will be handled by the state or federal courts located in Alameda County, California, and you and we consent to their jurisdiction.
